These terms and conditions of sale govern orders for photo prints and other products placed by consumers on aluartmountains.com.

They set out in particular the characteristics of the products, ordering and payment procedures, delivery conditions, the right of withdrawal and statutory guarantees.

Pierre Thiaville, trading as AluArtMountains, is referred to below as “AluArtMountains” or “the Seller”.

2. Scope

These terms apply to distance contracts concluded with natural persons acting for purposes outside their trade, business, craft, liberal profession or agricultural activity.

The customer declares that they have the legal capacity required to enter into the contract.

Orders placed by professionals, assignments of rights, special installations and creations produced on quotation may be subject to specific terms.

Those specific terms supplement or replace these Terms and Conditions of Sale only for the matters expressly provided for in the corresponding quotation or contract.

3. Products

AluArtMountains mainly offers mountain photographs produced as photo prints on matte aluminium Dibond.

The photographs are created by Pierre Thiaville or partner photographers. The author is identified on the corresponding product page.

Essential characteristics include in particular:

  • the selected photograph;
  • the place or landscape depicted;
  • the photographer’s name;
  • the support and finish;
  • the sizes offered;
  • any hanging options;
  • the applicable price.

Room settings

Images showing a photo print in an interior are illustrative. They help assess its decorative integration but do not constitute an exact scale representation.

The customer must refer to the dimensions stated in centimetres on the product page.

Colours and appearance

The appearance shown on screen may vary slightly depending on:

  • screen technology and quality;
  • brightness, contrast or colour settings;
  • ambient light;
  • the characteristics of the support and printing process.

A normal difference in rendering between a backlit screen and a physical photo print does not necessarily constitute a lack of conformity.

4. Made-to-order production

Photo prints are produced after the order and payment have been confirmed.

This organisation makes it possible to produce the photograph in the size actually selected by the customer and to limit unnecessary production.

The fact that a product is manufactured after the order is placed does not make it customised where the customer only chooses from the standard photographs, sizes, finishes and options offered on the website.

5. Prices, taxes and charges

Product prices are displayed in the currency corresponding to the selected market or country.

The total amount payable by the customer, including applicable taxes, delivery charges and any other stated charges, is shown before the order is finally confirmed.

For metropolitan France, the current standard shipping rates are:

  • €9.90 for 20 × 20, 30 × 30 and 30 × 45 cm sizes;
  • €14.90 for 40 × 40, 40 × 60 and 50 × 50 cm sizes;
  • €19.90 for 50 × 75, 60 × 60, 60 × 90 and 70 × 100 cm sizes.

Certain products, destinations, large sizes or production circuits may be subject to different charges.

In all cases, the amount shown in the summary before payment prevails for the order concerned.

For deliveries outside the European Union, customs duties, import taxes or processing charges may apply in accordance with the shipping policy.

AluArtMountains may change its prices for future orders. The price applicable to a confirmed order remains the price shown to the customer when it was confirmed.

6. Ordering process

The customer selects the product, size, any options and the desired quantity.

Before final confirmation, a summary allows the customer to check and correct in particular:

  • the selected products;
  • sizes and quantities;
  • prices and any discounts;
  • taxes and delivery charges;
  • billing address;
  • delivery address;
  • the total amount payable.

Final confirmation creates an obligation to pay. The customer must accept these terms before confirming the order.

The sale is concluded when:

  1. the customer finally confirms the order;
  2. payment is accepted or authorised;
  3. AluArtMountains sends an electronic confirmation.

The customer must check this confirmation and report any error as soon as possible.

Refusal or cancellation of an order

AluArtMountains may refuse or cancel an order in particular in the event of:

  • payment being refused or not confirmed;
  • fraud or attempted fraud;
  • manifestly abusive use of the website;
  • exceptional unavailability preventing production;
  • an obvious pricing error that a normally attentive consumer could not reasonably have failed to notice;
  • an order abnormal in its nature or volume;
  • an unresolved previous payment dispute.

If AluArtMountains cancels an order after payment has been collected, the corresponding amounts are refunded.

7. Payment

Payment is made using the methods offered during checkout.

Transactions are processed by Shopify and the payment providers available at the time of purchase.

AluArtMountains does not receive the customer’s full bank-card numbers.

No additional charge is applied solely because a particular payment method is used, except any independent charge imposed by the customer’s bank.

Production begins only after payment has effectively been confirmed.

8. Production and availability

Production is usually completed within 1 to 2 calendar days from confirmation of payment.

This period may be extended in the event of:

  • high activity;
  • exceptional closure of the production site;
  • a technical difficulty;
  • an additional file check;
  • a particular constraint relating to the ordered size.

Where a product exceptionally cannot be produced, AluArtMountains informs the customer and, depending on the circumstances, offers:

  • an additional period;
  • an alternative solution subject to the customer’s agreement;
  • or cancellation and refund of the relevant order.

9. Delivery

In metropolitan France, delivery generally takes 3 to 6 business days from confirmation of the order.

For other destinations, times depend in particular on the country, size, production site and available transport services.

The date or period shown during checkout and confirmed to the customer constitutes the estimate applicable to the order concerned.

Where no specific date or period is stated, delivery takes place no later than within the applicable statutory period.

An order containing several products may be shipped in several parcels and have several tracking numbers.

Detailed arrangements are set out in the shipping policy.

10. Transfer of risk

Where delivery is performed by a carrier offered by AluArtMountains, the risk of loss or damage transfers to the customer when the customer physically takes possession of the product, or when a third party designated by the customer receives it.

AluArtMountains remains the customer’s point of contact for transport problems even where production or shipping is entrusted to a provider.

Where the customer independently chooses a carrier that was not offered by AluArtMountains, risk may transfer when the product is handed to that carrier.

11. Right of withdrawal

For standard catalogue products, a consumer customer has 14 calendar days to exercise the right of withdrawal.

The period begins on the day after the product is received by the customer or by a third party designated by the customer, other than the carrier.

The customer may communicate the decision by means of a clear and unambiguous statement sent to:

The customer may also use the model form in the returns and refund policy.

After communicating the decision, the customer has 14 days to return the product.

The direct return costs resulting from a change of mind remain payable by the customer.

The refund includes the product price and the initial delivery charges corresponding to the least expensive standard method offered.

The refund may be deferred until the product is recovered or until proof of dispatch is received.

12. Genuinely customised products

The right of withdrawal does not apply to products made to the customer’s particular specifications or clearly personalised.

This exclusion may in particular concern:

  • a specially created size not in the catalogue;
  • a photograph supplied by the customer;
  • addition of text, a logo, date or personal element;
  • retouching or a composition created specially;
  • a specific crop approved solely for the project;
  • a professional creation produced to a specification;
  • a product specially produced outside the standard range.

The customer is informed of this exclusion before the order or quotation is confirmed.

It does not limit the customer’s rights in the event of a defect, damage or lack of conformity.

13. Returns and refunds

The customer must contact AluArtMountains before shipping anything in order to receive the return address and instructions appropriate to the product.

This contact allows the return to be organised correctly. It is not a request for prior authorisation where a right of withdrawal or statutory guarantee applies.

No product should be returned directly:

  • to the address shown on the parcel label;
  • to AluArtMountains’ administrative address;
  • to the carrier;
  • to the production partner.

14. Damaged, defective or non-conforming product

The customer must contact AluArtMountains as soon as possible after identifying in particular:

  • damage in transit;
  • a printing or manufacturing defect;
  • the wrong photograph or size;
  • a missing element;
  • a difference between the product received and the order.

To help process the case, the customer should provide where possible:

  • the order number;
  • a description of the problem;
  • a full photograph of the photo print;
  • detailed photographs of the defect;
  • in the event of transit damage, photographs of the packaging, protective materials and label.

The photo print and packaging must be retained until the case is closed or until instructed otherwise.

AluArtMountains reviews the request as seller and arranges the appropriate solution.

Given the nature of the photo prints, bringing the product into conformity will generally take the form of a new conforming print at no cost to the customer.

This procedure does not limit statutory guarantees.

16. Intellectual property

Photographs, texts, visuals, logos and other content presented on the website are protected by intellectual property rights.

Depending on the item concerned, they belong to Pierre Thiaville, AluArtMountains, the photographers concerned, their rights holders or third parties who have authorised their use.

Purchasing a photo print transfers ownership only of the physical copy ordered.

It does not transfer any right to reproduce, distribute, modify, publish or commercially exploit the photograph.

17. Personal data

Data necessary to manage orders, payments, deliveries and after-sales service is processed in accordance with the privacy policy.

18. Force majeure

Neither party may be held liable for delay or non-performance directly caused by an event meeting the criteria for force majeure under French law.

AluArtMountains informs the customer as soon as possible where such an event affects an order.

If the impediment becomes permanent or durably deprives the contract of its purpose, the consequences are determined in accordance with the applicable legal rules.

19. Complaints

The customer must state the nature of the request and provide the order number where one exists.

AluArtMountains endeavours to find an amicable solution to every admissible complaint.

20. Consumer mediation

After a prior written complaint to AluArtMountains that has not resulted in a satisfactory solution, the consumer may use, free of charge, the consumer mediator whose scheme covers AluArtMountains.

21. Applicable law and disputes

These terms are governed by French law.

This does not deprive a consumer residing in another country of mandatory protections granted by the law applicable in the place of residence.

Where no amicable resolution is reached, the dispute may be brought before the competent court in accordance with applicable legal rules.

22. Archiving and evidence of contract

Orders and their confirmations are retained on a medium that preserves their integrity for the applicable statutory periods.

Where an electronically concluded contract concerns an amount of €120 or more, it is archived for ten years.

The customer may request access to the archived contract by contacting: info@aluartmountains.com.

Order confirmations, invoices, electronic communications and data recorded in Shopify and AluArtMountains systems may constitute evidence, subject to applicable legal rules.

23. Changes to these terms

AluArtMountains may change these terms to reflect legal, regulatory, technical or commercial developments.

The last-updated date is shown at the beginning of the page.

The terms applicable to an order remain those presented to and accepted by the customer when the order was confirmed.
